Land Use & Zoning

Mr. Conlon has more than 25 years of experience in zoning and land use law on long Island representing both the public and private sectors. On the public sector side Mr. Conlon has represented municipalities in the capacity of town attorney, village attorney, zoning and planning board attorney, representation of historical and environmental boards and commissions and representation of special purpose municipal districts.  His municipal representation covers the full range of land use issues including municipal law, local government affairs, rezoning, general plan amendments, development agreements, annexations, and infrastructure and impact fee issues zoning, land use, planning and real estate; water and sewer contracts; municipal utilities; environmental; condemnation; economic development; tax increment financing; special assessments; ordinance, local law and charter drafting; tax appeals; and general litigation. On the private sector side Mr. Conlon has represented owners, developers and builders across Long Island and New Your State.  Mr. Conlon’s private sector representation includes zoning analyses, including zoning status, development potential, review of zoning calculations and drawings, and strategic advice, zoning opinions, memoranda and letters for sellers, purchasers, borrowers and lenders, transfers of development rights, preparation and review of Declarations, Zoning Lot Development Agreements, and related zoning documents, transactional support, including drafting and reviewing zoning related provisions of purchase and sale agreements and ground leases, representation and advocacy for projects requiring approval of the City, State, County and local Planning Commission, Community Boards, Borough President, and City Council, including authorizations, certifications, special permits, zoning district changes, text amendments, dispositions of government owned property, and other matters subject to state and municipal jurisdiction. Mr. Conlon’s private practice also includes litigation support, including expert testimony and technical assistance on land use and zoning issues.

Notable projects on Long Island Mr. Conlon has been involved with include the development of EAB Plaza in Uniondale (zoning change and site plan development), Peconic Landing, CCRC, Southold (change of zone, site plan and CCRC approvals), Central Islip redevelopment project with New York Institute of Technology in Islip. (redevelopment of 1000 acre Central Islip Manhattan State Hospital), acquisition and development of Phipps Estate into Spring Hill (ultra-high-end residential community).  Additional Projects available upon request.

Some of Mr. Conlon’s public sector clients include the Incorporated Village of Mill Neck (all boards and agencies), the Incorporated Village of Centre Island (all boards and agencies) the Town of Lake Pleasant (town council and all boards, commissions and agencies) the Glen Head Waste Management Special District (as general counsel). Mr. Conlon has represented thousands of real estate owners, developers and builders all across Long Island and New Your State. Mr. Conlon has served as general counsel to the John C. Kean family of premier building and design companies for more than a decade including Kean Development Company, and all its design and other subsidiaries. 

Mr. Conlon is admitted to all New York State Courts, the Federal District Court for the Eastern District Of New York, The Federal Circuit Court of Appeals for the Second Circuit, and the Supreme Court of the United States.
